Terms of Service

These Terms of Service ("Terms") govern your use of FindYourFractional ("the Platform"), operated by Ops First Consultancy ("we", "us", "our"). By creating an account or using the Platform, you agree to these Terms.

1. About the Platform

FindYourFractional is a marketplace connecting businesses with vetted fractional professionals (CFOs, CTOs, CMOs, and other senior leaders) for part-time, flexible engagements. We facilitate introductions - we are not a party to any engagement between a fractional professional and a business.

2. Eligibility

  • You must be at least 18 years old
  • You must provide accurate and truthful information
  • Fractional professionals must operate through a registered UK company (Ltd, LLP, or PLC) and hold professional indemnity insurance
  • One account per person - duplicate accounts may be removed

3. Account Types

Fractional Professionals

  • Your profile will be reviewed and vetted before going live
  • You must maintain accurate, up-to-date information on your profile
  • You are responsible for your own engagements, contracts, insurance, and tax obligations
  • Subscription tiers (Free, Pro, Premium, Elite) provide different features and visibility

Businesses

  • You can browse profiles, post job opportunities, and contact fractionals
  • You are responsible for your own due diligence when engaging a fractional professional
  • Job postings must be genuine and not misleading

4. Vetting

All fractional professionals are subject to our vetting process, which may include LinkedIn verification, company registration checks, and a verification call. We reserve the right to reject or remove any profile that does not meet our standards. Vetting is not a guarantee of quality or suitability - businesses should conduct their own due diligence.

5. Subscriptions and Payments

  • Fractional professionals can subscribe to paid tiers for enhanced features
  • Payments are processed by Stripe. By subscribing, you agree to Stripe's terms of service
  • Subscriptions renew automatically unless cancelled before the renewal date
  • Refunds are handled on a case-by-case basis - contact us within 14 days of payment
  • We reserve the right to change pricing with 30 days' notice

6. Acceptable Use

You agree not to:

  • Provide false or misleading information
  • Use the Platform for spam, harassment, or illegal purposes
  • Scrape, copy, or redistribute Platform content or user data
  • Circumvent the Platform to avoid fees (e.g. taking introductions off-platform to avoid subscription)
  • Impersonate another person or entity
  • Upload malicious code, viruses, or harmful content
  • Use the Platform in any way that could damage, disable, or impair its operation

7. Content and Intellectual Property

  • You retain ownership of content you upload (bio, photos, case studies)
  • You grant us a licence to display your content on the Platform for the purpose of providing the service
  • We own the Platform, its design, branding, and underlying technology
  • You may not use our branding without written permission

8. Limitation of Liability

FindYourFractional is a marketplace platform. We do not employ fractional professionals, and we are not a party to any agreement between a fractional and a business. To the fullest extent permitted by law:

  • We are not liable for the quality, suitability, or outcome of any engagement
  • We are not liable for any loss of profit, data, or business opportunity
  • Our total liability to you shall not exceed the amount you have paid us in the 12 months preceding any claim
  • Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence

9. Termination

  • You can delete your account at any time from your settings
  • We may suspend or terminate your account if you breach these Terms
  • On termination, your profile will be unpublished and your data handled per our Privacy Policy

10. Dispute Resolution

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved through good-faith negotiation in the first instance. If a resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the Platform. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
